Terms and conditions
These terms govern every order placed on this site. They are written to be read: what it costs, what takes time, and what you are entitled to.
This translation is provided for your convenience. In the event of any discrepancy, the French version prevails.
01Purpose and acceptance
MAMALIGA sells clothing and accessories printed to order, to consumers and businesses alike. Confirming payment means accepting the price, the chosen item, its size, the delivery method and these terms, in the version online at the time of the order.
02Products
Each piece is made after payment; nothing is kept in stock. The images shown are simulations produced from the print files: the actual result may vary slightly in shade and placement, which is not a defect. The stated characteristics (material, fabric weight, cut) are those supplied by the textile manufacturer.
03Prices
- Prices are shown in euros, including any applicable taxes.
- Shipping costs are shown separately before payment and are added to the price of the items.
- We may change our prices at any time; the applicable price is the one displayed when you confirm the order.
04Customs duties and import VAT
Your set is printed to order by our print partner in the United States and shipped from there. To the 27 countries of the European Union, as long as the parcel is worth less than 150 EUR, which a single set is, our partner declares and pays the import VAT in advance through the EU's one-stop shop (IOSS): the carrier has nothing to charge you on delivery. Above 150 EUR, in practice from two sets in the same order, and for any delivery to Switzerland or the United Kingdom, the carrier may collect import VAT, customs duties and its own handling fee on arrival. These amounts are set by the authorities of the destination country, do not come to us, and are included neither in the displayed price nor in the shipping cost.
In practice: the amount you pay here is not necessarily the total cost of the transaction, and the balance is collected by the carrier on delivery. A parcel refused at that stage comes back to us; we then refund the price of the items, minus the return costs actually incurred.
05Order and payment
The contract is formed when payment is confirmed and we send you the order confirmation. Payment is processed by Stripe; we never have access to your card details.
Production starts only once payment is confirmed. We reserve the right to refuse or cancel an order in the event of an obvious pricing error, suspected fraud, or inability to deliver to the address given, with a full refund.
06Delivery
- Europe and Switzerland: €19.90, 10 to 30 days.
- United States and Canada: €8.49, 7 to 20 days.
These times run from payment confirmation and include production. They are estimates and may be longer during periods of high demand. An order containing several items produced by different workshops may arrive in several parcels, on different dates, at no extra cost.
If delivery has not taken place within a reasonable time, write to us: you can set us an appropriate additional period and, if it is not met, terminate the order and obtain a full refund of the amounts paid.
The delivery address is the one you enter. A typing error that leads to the loss of the parcel cannot be held against us, so check it before paying.
07Withdrawal
You have 14 days after receipt to withdraw, without giving a reason, across the whole catalogue. The terms, costs and model form are set out on the Returns page, which forms an integral part of these terms.
08Guarantees
All items benefit from the legal guarantee of conformity for 2 years from delivery, as well as the guarantee against hidden defects. In the event of a production defect, a wrong item or damage in transit, the reprint or refund is at our expense, return costs included.
09Liability
Our liability in respect of an order is limited to the amount of that order. Nothing in these terms limits our liability for intentional misconduct or gross negligence, nor restricts the rights that the law grants to consumers on a mandatory basis.
We are not liable for delays caused by force majeure, a carrier strike or goods held in customs.
10Governing law and disputes
These terms are governed by Swiss law. This clause does not deprive a consumer residing in the European Union of the protection afforded by the mandatory provisions of the law of their country of residence.
In case of disagreement, write to us first at dracula@mamaliga.ch: we look for an amicable solution in every case. Failing that, you remain free to refer the matter to a competent consumer mediation body in your country, or to the court of your place of residence.
